Legal Question in Immigration Law in New Jersey

Marrying someone with H-1 visa

My girlfriend and I want to get married. She is a foreigner currently on a H-1 visa. She's been here for about 2 years. I am a US Citizen. She lives about an hour from me. We want to live in my area, but she needs to get a job here first. (She's a Special Ed teacher). How soon after we get married can she work somewhere besides the company who sponsors her? What forms do we need to fill out? What is the proper process to get her residencey/green card?

A work authorization document is issued 60-90 days after filing of the adjustment of status applications.

Re: Marrying someone with H-1 visa

There are a few different options for your fiance. First, she can have another school sponsor her H-1B, and may be eligible to begin working there immediately.

Alternatively, once you are married, and she submits her applications to USCIS (including an application for work authorization), she should receive such authorization within 90 days of filing. Upon receipt, she will be eligible to work for any employer.

You should consider speaking with an attorney to discuss the entire green card process in detail.
