Legal Question in Immigration Law in New Jersey

Section 245i

I won the 2005 greencard lottery. I am now out of status. Overstayed my visa after my masters degree. Is there any hope of 245i revival. If not, do i have any other options?

How long do i have to apply after winning?

Thank you.

Re: Section 245i

First you should check to see if you made a qualifying 245(i) filing before April 30th of 2001. If not, did one of your immediate relatives make such a filing (because you may be able to get the benefit)? If neither of the above will work for you, consider whether you have not accrued "unlawful presence" in the U.S. For example, there are some forms of nonimmigrant status in which you do not accrue unlawful presence (i.e., F, J, I). If you would like to discuss your options please feel free to call our office at 201-236-9998 for a consultation.

Re: Section 245i

Did you file anything before winning the greencard lottery that might qualify for section 245i? I would need to see a copy of the I-94.
