Legal Question in Insurance Law in New Jersey

homeowners insurance

I own 1/4 share in a house occupied by my brother. He occupies the house 4-5 monthe of the year. The rest of the time the house is vacant.

I have been told that if anything happens to or at the house while unoccupied and the insurance company was not told that the house would be left vacant they will deny any claims and void the policy.

Is this true and if there is a claim made, is the house we live in jeporady?

You do have a problem. You can understand that vacant houses are much more likely to have kids throw rocks through the windows or do other damage, there is no one to detect and quickly stop leaking pipes or a broken window letting in the rain, and other very substantial differences from a house which is occupied. The risks of damage to a vacant house are higher.

Talk to your insurance agent.

You are at the other end of the State of New Jersey, so I really can not assist you.
