insurance company won't total car

hit from behind waiting at a red light--name removed--The person did't even brake and hit me at about 35-40 miles per hour (no skid marks)and pushed me into the vehicle in front of me--name removed--the car is a 2006--name removed--civic in pristine condition with 36,000 miles on it--name removed--the person who it me admitted fault and his insurance does't not want to total car--name removed--i want the car totaled--name removed--the auto body which his insurance gave us from a list said the car is in really bad shape and he can not fix it at his shop--name removed--insurance co now wants it towed to a--name removed--dealer to get fixed--name removed--we still owe $9000--name removed--we had a beautful car and now they want us to take back a car that will not be the same--name removed--what can i do. insurance co is state farm

this does not happen often, but when it does, it just makes people hate insurance companies even more than they dislike lawyers.

go see a lawyer. I know several good guys here in Bergen and Passaic counties who can assist you. I do not do this work.
