Use of art design

I recently completed a piece of artwork using the design from an image I thought was public property. On closer inspection the image which had appeared on a book jacket was designed by an artist and stated on the jacket. Do I contact the artist and simply ask for his/her terms for use of the image?

The answer to your question really requires more information about the nature and character of the image from the book, the scope and character of the design you used in relation to the image from the book and to your artwork. For example, while the image itself may be copyrightable, the design may or may not be copyrightable or may not be owned by the person that created the image. Contacting the artist of the image may be the most direct approach, but you should consider consulting with an attorney to review the copyright issues here and your legal options before making such contact.
