Legal Question in Landlord & Tenant Law in New Jersey

Apartment rental

I own a 1/4 share in a 2 family house. My brother also owne a 1/4 share. Someone else owne the 1/2 share. My mother lived there and my brother came to live with her for the summers a few years ago. He helped a little with the household expenses and she paid the taxes. Now she has died and my brother told me that I need to pay my share of the taxes. He did not mention paying me rent although he is living in the apartment that we both own.

Is he obligated to pay me 1/2 of the going rent for similar apartments in the area?

If he is going to live in the house he should at least pay the taxes which on a monthly basis is usually less than the monthly rent which would normally charged for the house. If you both occupied the house I could see your sharing the taxes. if the house were rented out the rent would cover the taxes.

this is the kind of messy family problem that can occur with a shared 2 family house, even if everyone is careful and reasonable.
