Rent Law (sec. deposit)

I happen to know the previous tenants (one is still on the current lease) and know that the landlord charged them for damages to the carpeting and made them pay the entire costs of the carpet and installation...and then never replaced it before we moved in. Now he is trying to charge us again for damage to the carpet and while we did significantly damage the carpet (pet stains and a burn mark) it was never replaced for us from their sec. deposit. Can he charge again for the same carpet when he was already paid in full for it?

There is a crime known as theft by deception. Some prefer the term "fraud." You might explain to your landlord that you can prove what he has been doing and that should he try it with you you will go directly to the police.
