Return of Security Deposit, or Not

Ex-landlord has 30 days to return a security deposit, correct? It's been 33 days, and no despoit received, so how long should I continue to wait before I sue? Is there a ''grace period'' or is he already in violation of my rights where I can sue for damages?

N.J.S.A. 46:8-19 covers the Rent Security Deposit Act.

The landlord should return your security deposit within 30 days of vacating the premises. You can send a formal demand letter requesting the return of the deposit plus the interest it accrued.

If all else fails, take the landlord to small claims court to recover the deposit.
