Legal Question in Medical Malpractice in New Jersey

Healthy Tooth Extracted

Our son went in for oral surgery to remove four wisdom teeth and the surgeon mistakenly removed a healthy adult molar that was under the gum and left the wisdom tooth, which has recently broke through the gum. Recently, we agreed to have them put on a full set of bottom braces and perform a dental procedure that will to pull the tooth into place. We are writing a letter to the oral group asking for monetary compensation. He is an socially active adult college student and will require him to travel from home and school for frequent visits in addition to the pain, discomfort and limitations of wearing braces. Our question is how much should we ask for remuneration? He is 19 and prior to the surgery had perfect teeth and bite. We believe there should a ''reward'' for having the sole responsibility of correcting the gross neglegence of the surgeon. We have taken a ''wait and see'' approach since the surgery last January and now that the braces are on and reliving the shortcomings of having braces and the discomfort associated with this procedure.

You should get a lawyer to handle this matter. It is way too complicated for a lay person. You do not know what damages are compensible, have no idea about possible liens and do not have the resources to figure out how much the claim is really worth.
