The applicable statute of limitations requires a lawsuit within two years following the act of neglitgence. The exception is where one learns of the negligence only after the two year period has elapsed. This is called the discovery exception. Of course, it is very difficult to prove that

the negligence was not easily discoverable within the two year period, which is a requirement

of the discovery exception.
