Legal Question in Personal Injury in New Jersey

My lawsuit

I have a lawsuit pending from a car accident to 2 years ago, the insurance company decided to to settle for $25,000 dollars but my lawyer said they retracted the offer, am I allowed to request all documents regarding my case?? I'm really not please with my lawyer at this time and I need to know my rights regarding my case.

It is always difficult to know what is really going on when another attorney is handling the case.

Yes, you can request a copy of all of the documents in your case. Your attorney will be very reluctant to give these to you, because it means you are questioning what the attorney is doing.

You always have a right to see your file, however possesion is retained by the attorney as a lein until the expenses are satsified or arrangments are made.

You can demand to see the file and havea right to do so. If the attoreny refuses you should contact the Office of Attorney Ethics.

As to changing lawyers, typically you can do this at anytime with no cost to you in addition. The new and old attorney have to resolve the fees and expenses without any increase in the fee to you.

It is unusual to have an offer pulled. This generally means that there has been a change that signifies that your position is weaker, except for a very rare circumstance where the issue is personalities.

As to one of the other attorneys who offered to look at the file for the fee, I advise against that. If the case is worth taking it is worth reviewing at no charge.
