Legal Question in Personal Injury in New Jersey

We live in NJ. A driver charged with DUI crashed into our chain link fence/cinder block wall. Unfortunately, our house insurance policy has a $1000 deductible.

We won�t have the police report until Friday.

How do we recover the deductible?

Assuming he has insurance, does his carrier pay? Do we take him to small claims court?

Any advice would be appreciated.

Get a copy of the accident report. The report has the number of the insurance company for the driver's car. Call the police and find out which company it is and call the driver's insurance company to make a claim against his policy. It seems clear that the insurance company will be

obligated to pay up to the maximum property damage coverage of the the driver's policy, which by state law must be no less than $1,000.00.
