Parking lot fall

If I fell from a pothole in a supermarket parking lot and broke my ankle, other than the owner of the parking lot covering my medical expenses, what are my legal ramifications.

You have a likely legal remedy against the owner of the parking lot. The owner of land used for business has a duty to people who come on the land for business to keep the property in a safe condition. This includes the duty to repair potholes, and to inspect for them. Of course you also have a duty to watch where you are going, but it isn't always so easy to do that if you have a cart in front of you, or packages in your arms.

Even if you are not disposed to sue, you should IMMEDIATELY contact an experienced personal injury attorney, one who can assure you that he will conduct an immediate investigation. The following steps need to be completed as quickly as possible.

1. There needs to be a site inspection by a qualified investigator, who will take measurements and photographs of the precise loacation of your fall, and of the lot and premises in general. If you reported your accident, or someone else has, the landowner is likely to make reparis. While that is laudatory, they are under no obligation to preserve evidence of their own negligence. You need to move quickly.

Secondly, you must identify the probable defendants. Was the market a single store pad site, or in a multi store facility? Is the store an owner, or a tennant? Is there a third party who is contractually liablle for the inspection and maintenance of the lot? These are all questions which need to be resolved for the proper presentation of your claim.
