Legal Question in Personal Injury in New Jersey

Minor - Mall - Water Spill

In July 2002 my daughter; then 13, accidently spilled a little water on the floor of the mall. (the cup had no lid) When she went to get help someone slipped on it and was injured. When she came back, the lady was on the floor and security was there. When the police came she told them that she accidently spilled it & the lady slipped while she was gone to get help. Now 3yrs later the lawyer for the lady contacts us and wants to sue us for her medical bills, pain, wages lost & legal fees. The lawyer told me they've been in talks with the mall for 2yrs and they didn't realize her name was on the accident report until just this past Aug (2005). Can they do that? Why are we responsible when the cup didn't have a lid? Isn't there a statute of limitations? We don't have home owners insurance otherwise I would just submit it to them, but they want to sue my husband & I personally because she is till a minor (now 16).

The statute of limitations is 2 years from the date of the accident. A summary judgment will need to be filed on your behalf. If you need more information call me at 732-286-2170.
