Legal Question in Personal Injury in New Jersey

Running red lights!

I was involved in an accident in which the other driver ran a red light. He is now denying that his light was red. The police report says that he "failed to yeild to a red traffic signal." Can he contest that and will he succeed in turning the responsibility of the accident to me? Also, can he ask my insurance company to pay for his damages?

He CAN do anything he wants to do. Whether he will ultimately be successful is another issue. You have not indicated whether your action involves a ticket on the Municipal Court level, litigation in the Superior Court or a claim that is unfiled and still being determined by one or more insurance companies. The other driver can change his story--

The only way the police knows that he ran the light was if

1) the officer saw it, and/or

2) the officer was told this by other driver.

Send your insurance company the police report. It will go a long was to helping you settle the claim--with both insurance companies--yours and his.
