Slip and Fall at work

Hi, I fell at work in the pantry room where a cleaning lady was washing floors in the afternoon, the busiest time when people get their coffee. There were no signs that the floor was wet. Fortunately I did not break anything but I got really bad muscle strains on my lower back and hands. Do I have any rights? Can I file a suit? And if the answer is 'yes', is it against the cleaning company or is the agianst the company I work for? Thank you very much

If there is a separate company that perfomed the floor washing, then you may have a claim both against that company [called a 3rd party claim] and a worker's compensation claim agaisnt your employer as you were hurt at work. If the cleaning woman was employed by your same employer, i.e., you both work for ABC Company, then you have no claim other than a worker's comp claim. If she was employed by someone else, you have both a "third party" claim and a comp claim. Remember, in addition to comp paying you temporary disability (if you are out of work for more than a week) and your medical bills, you are entitled to a "permanency award".

You Have 2 Possible Cases

You have two potential case. The first a Workers Compensation Case for the permanent injuries you received as part of your fall.

The second is a potential "Third Party Case" against the cleaning company who didn't put out warning signs to indicate that the floor was wet and thus slippery.
