Sued by Physical Therapy after case settled

Was a passenger involved in Motor Vehicle accident back in 1995. Sued driver�s insurance and went into arbitration, case was settled in 1998. Just found a civil judgement on credit report, Physical Therapy company was not paid and I was sued. Have since contacted attorney who handled my case throughout this last 3 weeks, spoke to him once and rest only got secretary, keep saying they cannot find my files. I�ve been getting the run around from this attorney�s firm and can�t get a hold of attorney.

Question: Shouldn�t my physical therapy treatment been included when settlement was made with insurance company? Firm will not answer this question. If it comes down to me paying the PT bill, can I sue my attorney for mis-handling my case? I�m going nuts�What are my options? I did not own a registered vehicle and no one in my household owned a registered vehicle at time of accident.

you need to look at the distribution sheet and see if the money was withheld. You also need to find out if a letter of protections was issued by your attorney and who was served with the law suit from the PT . How much is involved? It may not pay for you to pursue, however, if you are really ticked off at your attny, you can file ethic charges. This will not get the money paid, but will get your filed delivered to you so that you can see what happened.
