Water Drainage Problem

The state of New Jersey has a state road with two storm drains that are dumping run-off water from the highway, through my property. This is causing major flooding on my property, eroding my property all away, and coming close to totally flooding my home out. This problem has also caused a 3 foot wide, 3 foot deep trench through the length of my property. I am also concerned that one of my children are going to get caught up in this and drown. The township seems to want to do nothing about it, nor does the state. Plesse let me know if I have any legal recourse. Thank you very much. Jim--name removed--

Since the water is coming from a state road, you have to contact the state highway department for recourse. If you get no satisfaction, I suggest you contact your state representatives and the governor. The Township cannot do anything, as they have no jurisdiction over state roads. However, if there are reasonable local officials, they should be willing to assist you. Be sure to take pictures of the damage and, especially, during or after an event so you can document the source (videos if possible). I also suggest that you get an estimate from an engineer and landscaper to use with your claim.
