Legal Question in Social Security Law in New Jersey

Ssd benefit amount

social security calculator estimates that each month i would get 1128.00 in disability benefits and surviving child and wife would get 846.00 each, that total is 2820.00 total family benefit is 1910.00. what does total family mean? all 3 of us as a family or my wife and kid are my family.

also i recieve w/c payments of 811.00 peer month, will that effect my ssd payments?

keep in mind the mail i got from the social security administration today that said i met the medical requirements for disability but they have not made a decision on the non medical requirements. what does that mean, what do they collect for the non med. part? how long will that take? please un confuse me...

Re: Ssd benefit amount

The SS calculator is only an estimate and the non-disability requirements including doing the calculations to determine your benefit. Without seeing the document, I'm guessing but I think you are mistaken that child and spouse benefits are $846 each. That $846 is probably the total for both.

The family benefit you mention at $1910 is the maximum for you, your wife and child.

However, as long as you are receiving a monthly Workers Comp benefit, your social Security benefit will be reduced. That is more of the 'non-disability' calculations the SSA is doing. Be ready to provide a copy of your Workers Compensation benefit award documents, otherwise SSA cannot do the calculation. SSA is not quick about doing these calculations, so don't expect anything for 60 days at least.

If you take a lump sum settlement of your Workers Comp, there is still a reduction of your future SS benefit and that will need to be recalculated. If your Workers Comp is terminated the SS reduction will end. So keep SSA informed about any WC changes.
