Legal Question in Traffic Law in New Jersey

My car got towed this morning for 3 charges ...

1. Past due for inspection (4 months late)

2. Unregistered for a year now (Registration has not been renewed since October 2009) and

3. Failure to produce Insurance card. I was able to get my current insurance card after coming home and thus validate my insurance's validity (but still have to show it to the court)

I have two summons:

1. For Unregistered vehicle (39, 3-4) and Failure to exhibit documents (39, 3-29) and

2. For (39, 6B-2) (This is what I can read off the carbon copy and may be incorrect. This one could be for inspection.)

Previous violation history:

I got 2 points 2-3 years ago

My car has been unregistered for a little less than a year (of course, all of this was unintentional and due to lack of oversight on my part) and I may get points, right? My situation last year was that my wife was pregnant and we delivered in Jan and she was bed ridden for 2-3 months. Between managing work, baby and my wife's health, I may have misplaced the registration renewal request letter. How do I handle this in the court in order to avoid points and minimize the penalty fees?

You need to get all you documents in order prior to the Court appearance, then speak to the prosecutor and ask for some leniency. You are facing a severe penalty and probably should get an attorney to assist you even if you are able to get your documents in order....I am sure the Judge told you this at the formal arraignment in Court.

For example the 6B2 is actually concerning no insurance card at the time of the traffic stop. For the first offense, a fine of not less than $ 300 nor more than $ 1,000 will be imposed, as well as a period of community service to be determined by the Court. There is a additional, extremely serious consequence: suspension of your right to operate a motor vehicle in NJ for a period of one year from the date of conviction.

The unregistered vehicle is also serious...it is NOT points, but rather a suspension of your registration privileges that is at issue. That means you potentially can't drive the vehicle legally....

The past due inspection (By the way, was the car impounded?) will cost you some money, but not affect your privileges.

Inutially, 39:6B2 is not failure to produce an insurance card. It is for operating (and failing) to have the vehicle properly insured. N J S A 39:3-29 is failure to produce the correct documents. The summons for no Insurance carries a fine between $300.00 and $1,000.00, a 1 year mandatory loss of your N J drivers License and other potential penalties. A second offense could result in a fine of up to $5,000.00 and 14 days in jail, so it is serious. failure to inspect is only a fine. the unregistered is a fine and could carry other penalties, but your overall situation could be potentially serious. You are not looking at points, but you are looking at losing your driver's license for a year on the 39:6B-2 ticket. These are all serious charges so you should definitely consult with a lawyer.
