Legal Question in Traffic Law in New Jersey

Can you be pulled over for a suspended license?

I was pulled over for having a suspended license. Is it possible to be pulled over for that? The license was suspended because of a parking ticket which has since been paid and is now reinstated.

Yes, the police can scan your license plate and determine that way if you(or rather, if the registered owner of the vehicle being driven)have a suspended license. However, based on what you say in the rest of your question, there may be a way to minimize the penalties you are facing for this ticket.I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past. I would like to discuss your case with you in more detail. Please contact me at your convenience. I never charge for simply talking to a person about a case. Thank you.

Re: Can you be pulled over for a suspended license?

In my opinion, it would depend on how he learned your DL was suspended. I just won a case on appeal where a cop "heard" that my client's DL was supsended but never actually checked. The Court held that this was improper and the conviction (poss of CDS with intent) was thrown out. I would have to examine the discovery to give you a better opinion, but you may have some room to work with. Feel free to call my office at 732/247/3340 if you need any assistance.

It is unlawful to operate a motor vehicle in New Jersey when New Jersey driving privileges have been suspended. Once he learned that your driving privileges were suspended the officer had a duty to stop you.

As for the ticket I can help you.
