Legal Question in Wills and Trusts in New Jersey

My father passed away in the begining of this year he had a will. He left the house to me, my brother & sister & my STEP Mother. He had prevoius will in 1991 & a prenup agreement leaving on the children the house. We also have a divorce agreement between my parents in 1984 leaving the kids the property & also all of the furniture. which my step mother already took. My question is does the original divorce agreement superceed his existing will?

I don't think that your question could be answered by anyone on LawGuru. There are too many issues.

You need to have an attorney sort out the issues and advise you.

This response is not legal advice, since I do not have all of the information that would be required, and I do not have a representation agreement with you.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.

Possibly.

I would need to meet with you and review the divorce papers as well as your father's will in order to determine your possible rights to his estate.

You have a mess on your hands. I understand what you are asking. I would need to see all the documents and talk to you about this to give you any advice. I have handled several cases like this. Your father has made a mess that you are going to have to deal with.

Give me a call, make an appointment to come see me, and I will go over this with you, and give you some advice. I will let you know up front what it will cost for me to help you.
