Child custody

Can I take my 2 week old daughter from South Carolina to New Mexico without my husbands consent. Once I do get her to New Mexico,what are my rights there?

If you are married - you made reference to 'my husband'

then both of you have equal rights to take your child

where ever you want when ever you want. However, if either

of you file for divorce or separtation then the Uniform

Child Custody Jurisdiction Act (UCCJA) will apply. You

can find a copy of that law as it applies to South Carolina

or New Mexico in the legal libraries available online.

Also, if you call the state bar in your state or where ever

you are and ask for lawyer referral you can sometimes find

an attorney who will answer your quetions - in an overview

manner - for an initial consultation charge of little to

no money. This would be your best approach.
