auto insurance accident statute of limitations

I was in an auto accident(not my fault) Oct 07. I have been fighting with them. They have refused treatment. Now they are telling me the statute of limitations expires and I am out of luck. what can I do?

The statute of limitations for personal injury cases is three (3) years in New Mexico. Based on your statement of the facts of your case, your statute of limitations does not expire until October 2010.
