Legal Question in Wills and Trusts in New Mexico
My father recently passed away leaving everything to my stepmother under the condition that when she passes everything is divided up between the children and stepchildren. Can my stepmother change this at anytime?

Yes. She can make a will leaving the property to whomever and however she wishes. There is no conditional gift under these circumstances.
