You do not provide enough information to answer your question because bail is not based only on the charge. In general however, a criminal defendant is usually entitled to some bail (even if very high) except in the most serious cases, generally A-I or A-II felonies). However, sometimes defendants are not entitled to bail on lesser charges depending on the circumstances. Remember, bail is to ensure a defendant's return to court. Thus, if the defendant has a history or warranting or is on parole or has no ties to NY, a court may remand the defendant without bail. I am a former federal and state prosecutor.
