Legal Question in Business Law in New York

LLC for multiple services

I provide creative services of many kinds. I want to form an LLC for protection. But I'm wondering if this would limit my protection and, if so, how? My services are as disparate as websites, photography, and even writing. Each of them would need a different business name.

Is it wise to offer different services under one LLC? And is it possible to practice under different names (DBAs?) for each?

I am also interested in finding an affordable lawyer to help create the LLC.

Re: LLC for multiple services

First of all, I charge just $97 to form the LLC, plus filing fees. I also offer the lowest price in NY on the required legal publishing.

Regarding your primary question, if money were no object, it is always best to form separate LLCs for each business. However, that is not practical for most people. The problem with your proposed setup is that if one aspect of your business becomes liable in any way, your other businesses are at risk.

If my answer is not 100% clear to you, feel free to send me an email and we can discuss further.

Re: LLC for multiple services

I read Brodsky's post.

To answer your question, an LLC limits liability. How? It is an entity - just like a corporation. You cannot sue the individual that owns the entity since the entity performed the service.

To answer your second question, it is possible that the LLC would have different dba's, although it is not recommended.

To create a different LLC for each business may be wise, but certainly more expensive. Although Brodsky charges $97, he fails to mention that you will have to file a tax return, pay franchise taxes, open a separate bank account, and possibly have separate insurance for each LLC. That may be expensive.

Finally, for $97, you get what you pay for.

Mike.

An LLC in NY is very expensive; you should set it up some place like FL or just get a NY corp. I'm licensed in NY and three other states and focus on Internet and intellectual property. Call or write if you want to discuss.
