Legal Question in Business Law in New York

help... loss of business

Our business is on the first floor of

an apartment building. About a

month ago there was a gas leak, so

the building shut down the gas

completely. Being that we're a

prepared fried food business, we're

losing tremendous business with no

gas, no stove. They said we'll have to

wait another 2 months or hire a

private contractor, and have our gas

fixed out of our own pocket. Please

help, i feel helpless and have no idea

what to do?

This is a question that is answered only in your lease agreement and in the local practice in your county.

Show the lease to your attorney and explain the problem; see what s/he can do to help. If you don't have an attorney, you need one; ask the NYState Bar Association (www.nysba.org) or your local county bar association for a referral.

Re: help... loss of business

You do have some options here, and I would recommend discussing them in detail with an attorney. Initially, I presume you have a written lease for these premises. That document should be fully reviewed to see if this problem is addressed. Our firm handles commercial matters such as this and I would be happy to speak with you further about your situation and what can be done. Please feel free to contact me at your earliest convenience should you wish to discuss this further.
