Legal Question in Business Law in New York

I am considering opening a business and am wondering what the best structure would be, sole proprietor or llc? I am looking to open a can and bottle redemption center. The only liability I can foresee is a customer having an accident either in the parking lot or in the store. Would it be necessary to have the protection for this type of business?

One never knows what accident might befall a customer. Better to be safe than sorry - form a LLC. Also, be sure you carry liability insurance also.

Though my colleague is correct as far as liability, you should also consider forming an s-corp which may have a tax advantage over a one member LLC.
