Legal Question in Civil Rights Law in New York

Display of religious articles

I live in a co-op in Howard Beach, Queens. There are four families in each unit. One tenant put a statue of the Virgin Mary in the common garden. Is that allowable? I am not of the Christian faith and would like it removed. What are my rights?

Re: Display of religious articles

This is not a matter of civil rights; it is a matter of contract law. The parties involved are all private actors and the dispute centers on the terms of your co-op.

Re: Display of religious articles

This would be governed by the by-laws of the co-op, and if they are silent with respect to displays in common areas is within the discretion of the board as to whether it is permissible or not.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.

Re: Display of religious articles

You need to take it up with the Board.

They should either remove it or give equal time to all denominations.
