Non-Compete Enforcability In New York State

My girlfriend signed a noncompete, left a company for a similar job, and now received a letter from her old job. How much trouble can she get in for violation of a noncompete in new york state? If she leaves her new job for a different one, will they back off?

Re: Non-Compete Enforcability In New York State

Non-Competes are generally very difficult to enforce unless they are very narrowly drawn and protect a legitimate interest. Without seeing the actual non-compete document, the letter from their attorney and knowing the details of your girlfriend's former and current employment, it is not possible to provide a clearer answer or tell you whether it is likely you can dispute their contention.

My firm specializes in this type of situation. If you are interested in discussing this further, please feel free to contact me at my office listed below.

Thank you.
