Legal Question in Construction Law in New York

Mechanic's Lien

A contractor did a deficient and incomplete job on our home as verified by a licensed architect/expert. The contractor has ignored my attempts to communicate with him and has now filed a mechanic's lien for the full amount he claims is due. What recourse do we have to get this lien removed?

Re: Mechanic's Lien

You may demand an itemized statement under NY Lien Law section 38. If the contractor fails to provide the statement, you may petition the Court to vacate the lien.
