Legal Question in Consumer Law in New York

Hello, I bought a car from a dealer. The car was defective, non functional from the day i bought it. The day I saw the car, it had check engine light which was removed by the dealer claiming it to be a sensor problem. The car has been with him for the past 22 days and non functional for over 26 days. He would not refund and threats me I could take him to court and he careless. I have been recording him in person also when I call him. He had been lying to me throughout the entire time with different stories each time. When I asked this to his mechanic, the mechanic informed me that the dealer has never ordered the part for the car until today. I would like to take him to the court, but with only concern whether the recording is legal or not because that is my only proof. The dealer would not provide me with anything.
