Legal Question in Credit and Debt Law in New York

Calls on a family members debt

A collection company has called me several times on merchandise I did not order. It was ordered by my father to lives in another state. It was delivered to him not me. I have told them who the responsible party is and his number yet they still call me. Tomorrow I am going to send them a certified letter to stop. Can I or my father sue them for discussing their account?

Re: Calls on a family members debt

A collection agency is not allowed to discuss your account with 3rd parties. So when the collection agency discussed your father’s account with you, they violated the FDCPA, and your father would have the right to sue them.

If your father wishes to pursue this, have him contact me at lawyer7000@gmail.com.
