Legal Question in Credit and Debt Law in New York

credit card statements

A credit card company cannot supply statements for a transaction that we have disputed but have required that we pay the disputed amount anyway. Do we have any legal options other than just paying it?

Re: credit card statements

I think they are wrong about that. Or you may not be accurate. The law is that if you dispute the statement, they have to put the disputed amount aside for the moment, but you have to pay the undisputed portion of the statement. You also have to cooperate with them in trying to resolve the dispute. Since you don't set forth the nature of the dispute I can't help you any further...you should gather your proof (that you don't owe whatever it is you are disputing and complete the credit card company's dispute resolution forms...Keep copies and mail everything CERTIFIED MAIL RETURN RECEIPT REQUESTED. If you don't agree with the credit card company's final determination, they may come after you...and your documents will be important items to have in court. Good luck.
