Legal Question in Credit and Debt Law in New York

IndyMac bank broke into our home

1) We are behind 3 months on our mortgage payments

2) Indymac has refused to renegotiate our loan and most importantly has refused to divulge the name of the who owns are loan (they only service it)

3) Last week a representative of Indymac bank drilled out our locks and forcefully entered our home (Indymac has confirmed that it was them who broke in).

Is this legal???

No. It is not legal to break into a home. To remove locks and take possession of a home is only legal if a judgment of possession is obtained and a Sheriff or Marshal oversees the eviction.
