Legal Question in Credit and Debt Law in New York

non-payment of wages

My son has his own business. I manage the financial part of his business. He is supposed to be paid within 45 days after the invoice has been sent. It is now 50 days past the day when he should have been paid. He has sent frequent reminders. What recourse does he have? The company owing him the money is out of state so it would be difficult to take them to court. Do you have any suggestions? Thanks.
