Legal Question in Credit and Debt Law in New York

Responsibility for Deceased's Debts?

My mother died in April. She left no property but had approx $40,000 in medical bills. I had power of attorney and was beneficiary for her $2,000 insurance. She and I also had $15,000 in a joint mutual fund account. I paid $8,000 for her funeral. Do I have to pay her bills from the money that she left me and/or from my own pocket? Her husband/my father is still alive. Is he liable for her debts?

Re: Responsibility for Deceased's Debts?

My condolences on the loss of your Mother.

Her Husband/your Father, MAY be responsible for your Mother's "necesities" which may include medical bills but you are not.

The Mutual Fund and insurance passed to you by operation of law and are not part of her estate.
