Legal Question in Credit and Debt Law in New York

Speak for brother on credit card account

My brother would like me to speak to his bank credit card co on his behalf for him. His wallet was stolen and was told any balance was his responsibility. I Have been just aware of this problem and would like to help resolve this problem. We have had to have a conference call every time we needed to speak to a customer service representative or any one associated with this account. What kind of a document do we need to get so I may talk on his behalf and also we live in different states (New York and New Jersey) which state would the document be drawn up in? Can a letter authorizating me to talk on his behalf be sufficient for this one time situation? Also, this debt has been going on since 1999. He has paid back more than the original amount not counting all the various charges applied since then. Should this matter be resolved by now? Any help in this matter will be greatly appreciated. Thank you

Re: Speak for brother on credit card account

You could get a power of attorney but that might be more than is needed. You really need to ask the company what they need. Sounds like he was the victim of identity theft. I focus a part of my practice on id theft assistance so if you need anything, feel free to give me a call.

Re: Speak for brother on credit card account

most likely you would need a letter of authorization that says you have the right to speak for your brother (he would have to sign it and it would be best to get it notarized)...that is pretty much what a power of attorney is...just not as formal. I do not agree that he is responsible for the balance if his wallet was stolen...he'd be responsible for the charges up to the date the wallet (and the card in the wallet) was stolen, but I don't believe he is responsible after (maybe the first 50 bucks. Ask Jef Henninger, Esq. about that...
