I assume the person is being charged with Criminal Sale of a Controlled Substance in the Third Degree - Penal Law � 220.39.

The sentence will depend on many, many things such as where the cases is pending, whether there has been an indictment, what the defendant's age and background is, how strong the case is (whether it is an undercover sale or sale observed by a police officer), etc.

Generally, a first time offender may be eligible for probation in a case like this but it depends on the circumstances.
