140.05 Trespass NYC

The offense:

My friends and I were exploring an

abandoned hospital and we were

written up by an officer and

charged with 140.05. The slip says

we were found in a fenced

construction site without

permission or authority. The officer

was very understanding and told

us it would not appear on our

records. He told us to show up to

346 Broadway and just plead guilty

and pay the fee.

Question:

We were wondering it we should

hire an attorney or take any other

measures before pleading guilty.

Also what would be the most likely

penalty or fine we will have to pay?

Would it be possible to pay the fine

before the court date or move the

date up earlier?

It is a violation as charged and is not a crime.A plea or finding of guilty will not constitute a criminal record. This is what is termed a violation and not a crime. A

Plea to such a charge would not leave you with a criminal

Record but could have other negative ramifications such

As affecting the citizenship or residency process if you

Are not currently a citizen or resident.
