i was charged under 175.10 in albany ny. they say i owe $12.000 to the state. Should i pay this prior to going to court for this

No, if you feel that you can pay restitution and wish to do so, you can give it to your attorney to put in his escrow account. This will allow him to verify that the amount is correct, verify the person or persons are correct and that there is a paper trail. An attorney can give you more specific information.
