Legal Question in Criminal Law in New York

illegal drug possession

My son was a passenger in a car that was pullled over for a headlight. He was searched and had an illegal drug in his possession. What type of charges can he face.

Re: illegal drug possession

The charge will depend on the type of the drug and its weight. His age or his prior criminal record are unlikely to play any role in what the initial charge is going to be. If he was a passenger in a car, there are certain search and seizure limitations that apply to the police action. This aspect should be carefully examined by a qualified attorney.
