Legal Question in Criminal Law in New York

I plead guilty to a class B misdemeanor 8 years ago. The initial charge was felony larceny which my lawyer seemingly bargained down to a misdemeanor, this was my first and only offense. Since then it has been exceedingly difficult for me to find a permanent job. My questions are: is there any way in the state of NY to have my record expunged or pardoned? Also, how can I tell of a potential employer is using this information as a means not to hire me? I have completed both my B.Sc and M.Sc degrees and companies are very interested in me until they come across my record.

First, are you signing any documents allowing the employers to see the record? Second, are the employers informing you that they will be doing a criminal background check?

As for expungement or sealing of your record, New York State does not have that option except in very limited situations and your situation does not fit into any allowable conviction.

You can apply to the Governor for a Pardon. It is a long shot but if you can make a compelling case, there is always a chance. Check the website: www.state.ny.us/governor for information on pardons.
