Legal Question in Discrimination Law in New York

Harassment of Gay Men

What laws are there pertaining to the harassment of gay men by straight men. Especially in the realm of them flirting and stalking. Is there a way to prove that a straight man has been stalking you online and in person other than a lie detector test? If no, are lie detector tests admissible in the New York and Federal court cases involving crimes like this? There are a group of straight men harassing me in this fashion. Yes I am gay and have been this way all my life. Given the size and stregth of the individual men and then to add the group on top it is a bit overwhelming and also a bit frightening.

Re: Harassment of Gay Men

Few lawyers will care about your sexual orientation per se. The part that will interest a lawyer is that you are being subjected to harassment.

You can report the matter to the local police. The action is a violation of the Penal Law under the title 'harassment'.

The police have the resources to track an email to the source. If you are being contacted by these persons "without a legitimate purpose" then you are being harassed.

The real question is: can you get the cops to do all this work? That is tough. The stories about 'donuts' are true. I recommend that you make the complaint with the assistance of a gay organization in your area. Have the organization take you to the police station with an appointment.

The police are generally not anti-gay; they don't really care who is gay, they are just a bit more energetic after someone is physically harmed.

You also have a civil remedy. You can sue them for money damages. But i recommend that you pursue the police report first and see how that works out. if they take a plea or are convicted of ANYTHING, then your civil case will be unbeatable. But if you start with the civil, the police will not touch the case.
