Legal Question in Discrimination Law in New York

Speaking in another language in the workplace

I have been employed at the same place going on 5 years. I am a bus driver among approx 65 employees. one of our mechanics speaks spanish and my direct supervisor does also, they happen to be best friends. There are conflicts going on at work right now, and every time i am any where in the vicinity of them they start speaking in spanish and laughing. for all i know they could be talking about the weather, but they do this in such a way that it intimidates me and the mechanic looks at me and laughs really loud. I have asked the mechanic to not to this, and he laughed at me again and said he can speak any language he wants and if i cant understand him then its not his problem and that he can say anything he wants.

I am not sure if i have listed the right area of law, if not please re direct me. thanks for your time.

THis may appear disconcerting to you, but he can infact speak any language he wants and unless he is attacking you on an issue of race creed or color, he is pretty much in the clear. Do you have a union?? You may want to bring it up with the shop steward.
