Legal Question in DUI Law in New York

dwi arrest after work holiday party

After the holiday party a bunch of us employees went across the street to a bar, we are at the legal age to drink. The next day one of the employees never made it to work, later on we learned that he had gotten himself into a car accident and got arrested for dwi, and he's ok. Now the hr dept, legal dept from work want a written statement of what had happened that night after the party at he bar. We feel the written statement is out of hand, this will be in our files and this happened after work hours! Should we write about what happened that night? We didn't do anything wrong, we were just hanging out at the bar and then we went home, and we all thought we were ok to drive! Work wants a written statement by Monday morning asap, why? Will this affect our careers? To my opinion I don't think I should write anything down on a piece of paper for work to keep...can I write No Comment on it? But I don't want to get in trouble either with my job for not writting anything down. I was thinking of just writing down that we were hanging out with other employees at the bar, I thought we were ok to go home and so we did go home!

They are asking for statements because if alcohol and/or drugs were available at the company holiday party your company may be implicated in the incident on the criminal side, civil side or both.

If you belong to a union, or if one of your benefits includes basic legal services, call that lawyer Monday morning and discuss the situation. If not, you can call the local Bar Association in your county and ask for a referral attorney. Those attorneys have agreed to charge a nominal fee (usually $25.00) for the consultation. It's well worth it.
