Nassau County Vehicle Seizure

I received a letter saying the county is going to seize my car. I do not seem to qualify to win the case since I lease the car, I don't have financial hardhips and they notified me within the time limit. Can I plea bargain the price o the car down and pay them a lesser amount or are there any other options I have. It was my 1st offence and a .08 level.

generally, most DA's offices will hold your vehicle until the end of your case. GIven the fact that the number you blew on the breathalyzer is literally the limit, there may be quite a lot of leeway to potentially end your case with a good result. Generally, the major problem with a first DWI conviction is the fact that there exists a law that if you are convicted again within ten years of the same offense, you may be subject to being charged with a felony and have to serve state time as a result. However, there may be a the possibility of protecting you from this potentially damaging result, as well as getting your car back.

It may be possible to save the leased car and also possible defenses to the charge. You are on the bac boundary, so with expert testimony, good cross-examination etc. it may be possible even in Nassau County to get either an acquital or a reduction.
