legality of faxed contracts

Are faxed documents, (contracts of sale) with faxed signatures legal, and enforceable by law?

Generally, in NY they would but there are evidentiary rules that relate to "best evidence" so if in court, the document is challenged and someone can prove an original, the original would be considered the "best evidence" and likely to prevail,, assuming a proper foundation can be established.
