Legal Question in Family Law in New York

attorney misconduct?

recently a friend appeared for a divorce proceeding only to be told that the judge was too busy to hear the case and my friend was directed down the hall in front of an arbitrator or another judge. during the proceeding, it appears that the judge misplaced important papers. also, the attorney asked my friend if she contacted her witnesses to appear. the matter was over in a short time and my friend was baffled by the whole thing. as she has related much that has happened between her and her attorney, I suggested that there was something very wrong with this whole matter. should she contace the NYSBA? Does this whole thing sound typical?

Re: attorney misconduct?

The only thing you said that the atty did was ask if she contacted her witnesses. Everything else sounds like it was beyond the attys control.

Perhaps you could re-write your question and state what the attorney did that might be considered "misconduct."
